These terms govern your use of PayCalculator.us, its calculators, content, software routes, and payroll-related services.

General
These Terms of Use apply to you if you are a PayCalculator.us Payroll customer, a PayCalculator.us user, or a visitor to paycalculator.us (the "Site"), and govern your use of the site and the tools and services available through it ("Services"). Additional terms and conditions may apply if you are a PayCalculator.us Payroll customer.
These terms constitute a binding agreement between you and HyprDev LLC and are deemed accepted each time you use or access the Site. If you do not accept the terms stated here, you are not permitted to visit or use the Site.
These Terms of Use, together with any additional or changed terms and conditions, including those set forth in the Privacy Policy for the Site, are referred to as this "Agreement." We reserve the right to change these terms at any time by reasonable notice, including by posting revised terms on the Site. Consult the most recent version of this Agreement each time you use the Site. You are not authorized to use the Site in any jurisdiction where this Agreement is not enforceable.
Eligibility
You must be 13 years of age or older to visit or use the Site. If you are at least 13 but under 18, or under the age of majority in your jurisdiction, you must use the Site under the supervision of a parent or legal guardian.
By visiting the Site or accepting this Agreement, you represent and warrant that you have reached the age of majority in your jurisdiction, or that you otherwise have the right, authority, and capacity to agree to and abide by this Agreement.
Disclaimer
Materials and Services made available on the Site are provided "as is" for general information only and without warranties of any kind. The materials and Services on the Site are not tax, financial, or legal advice and are not a substitute for a professional advisor, accountant, payroll specialist, or attorney.
Although we try to keep the materials and Services current, tax, payroll, and financial information changes rapidly. Accordingly, the Site should not be relied on as fully comprehensive or error free.
We do not recommend, endorse, or make warranties regarding the accuracy, completeness, timeliness, quality, efficacy, or noninfringement of any programs, materials, products, Services, or other information provided on the Site or by companies or organizations linked from it. We may post articles or materials provided by third parties, and those opinions are not necessarily our own.
Paid Subscription Site Registration
Paid versions of the Site may provide access to Services that are available only to users who subscribe and pay fees. To access those Services, you may be required to register and provide identifying or login information.
Your use of paid Services is governed by any additional terms that you are prompted to accept when creating your account, and those terms supersede inconsistent provisions of this Agreement with respect to the paid Services.
You agree to provide true and accurate registration information and to promptly notify us of changes. You are responsible for maintaining the confidentiality of your user name, login credentials, and access codes, and you are fully liable for all use of the Site and Services under your account.
Use of Site
All information on the Site, including software, code, text, photographs, graphics, logos, links, tutorials, design, images, audio or visual clips, and other material (collectively, the "Content"), is protected by copyright, trademark, trade secret, or other proprietary or intellectual property rights of HyprDev LLC or third parties.
Any code used to generate or display Content or the pages that make up the Site is also protected by copyright, trade secrets, and other intellectual property rights. You may not copy or adapt such code or otherwise infringe any intellectual property rights.
We authorize you to view and access unpaid Content and Services solely for your personal use and not for for-profit or commercial purposes or resale. You may not copy, store, modify, print, transmit, transfer, sell, create derivative works from, distribute, perform, display, reverse engineer, or otherwise exploit the Site, Services, or Content except as expressly permitted by this Agreement or applicable law.
We have no obligation to monitor the Site. However, you acknowledge and agree that we have the right to monitor the Site and to collect and disclose information as necessary or appropriate to satisfy legal requirements, operate the Site properly, optimize business operations, or protect HyprDev LLC, its users, customers, or affiliates.
Restrictions
Improper use of the Site may result in termination of account access and may result in civil or criminal liability.
- Infringe any third party's copyright, patent, trademark, trade secret, publicity, privacy, or other proprietary rights.
- Violate any applicable law, statute, ordinance, or regulation.
- Submit defamatory, threatening, harassing, invasive, abusive, hateful, discriminatory, pornographic, or obscene material.
- Interfere with or disrupt services or equipment or impose an excessive or disproportionate load on infrastructure.
- Knowingly distribute viruses, Trojan horses, worms, or similar harmful code.
- Prepare or distribute spam, junk mail, chain letters, pyramid schemes, unsolicited bulk email, or deceptive online marketing practices.
- Attempt unauthorized entry to machines, networks, servers, content, or accounts, or breach security or disrupt communications on or from the Site.
- Impersonate any person or entity or misrepresent your affiliation with one.
- Forge headers or manipulate identifiers to disguise the origin of any transmitted information.
- Collect or store personal data about other users, mine information about them, or attempt to gain access to their accounts.
- Execute network monitoring, packet sniffing, or related interception technologies against the Site or its communications.
- Circumvent authentication or security, create derivative works of our software or infrastructure, reverse engineer software, or use the Site to build or offer a competitive product or service.
- Sublicense, sell, rent, lease, transfer, assign, or commercially exploit any rights under this Agreement.
Content
Content is intended for individual consumers and is not intended to be relied on by employers or organizations for payroll administration unless they are authorized PayCalculator.us Payroll customers using the service for that purpose.
By using the Site, you represent and warrant that you will use Content for your own lawful purposes, will not aggregate or redistribute Site information, and will not use the Site commercially except as expressly permitted.
We are not responsible for content posted by third parties on the Site. We do not represent or endorse the accuracy or reliability of such content, and any reliance on it is at your sole risk.
The Site may contain links to external sites owned and operated by third parties. We are not responsible for the availability of, or content located on or through, any external site.
Third-party providers
Some Services or Content may be managed by third-party service providers. By using the Site, you agree that some features may depend on third-party services such as Auth0, Stripe, Crazy Egg, Intercom, and LogRocket, and those providers may have their own terms and policies.
We are not responsible for changes those providers make to their own terms, policies, or service offerings.
Links from and to this Website
You acknowledge and agree that neither we nor any co-branding providers are responsible for the accuracy or availability of information provided by linked sites. Links to external web sites do not constitute endorsement of the sponsors of those sites or of the content, products, advertising, or other materials presented there.
Information contained on external pages linked from the Site may come from a variety of sources, including customers, unofficial organizations, and unaffiliated individuals. We are not responsible for any damage or loss caused or alleged to be caused by use of or reliance on information, goods, or services available through external sites or resources.
User Comments and submissions
By sharing, submitting, or uploading any feedback, suggestions, comments, ideas, or other content ("User Comments"), you grant HyprDev LLC a worldwide, non-exclusive, royalty-free, sublicensable, and transferable license to use, reproduce, prepare derivative works of, display, and perform those User Comments in any lawful manner for our benefit, including in future modifications of the Site, other products or services, and marketing materials.
You are solely responsible for User Comments that you make available through the Site. You represent and warrant that you have all rights, licenses, consents, and releases necessary to grant those rights and that your User Comments and our use of them will not infringe or violate any law or any third-party right.
Indemnity
You agree to indemnify, defend, and hold harmless HyprDev LLC and its parents, subsidiaries, affiliates, members, officers, directors, owners, agents, information providers, and licensors (each an "Indemnified Party") from and against any and all claims, liability, losses, costs, and expenses, including attorneys' fees, incurred in connection with any use or alleged use of the Site or Services by you or by any person using your account or login credentials, whether or not authorized by you.
Each Indemnified Party reserves the right, at its own expense, to participate in the defense of any matter subject to indemnification by you, and you agree to cooperate in that defense.
Cancellation and Termination of Access to the Site
We reserve the right, in our sole discretion, to restrict, suspend, or terminate access to all or any part of the Site or Services at any time for any reason without prior notice or liability.
We may change, suspend, or discontinue all or any aspect of the Site or Services at any time, including the availability of any feature, Service, database, or Content, without prior notice or liability.
Disclaimer of Warranty
THE SITE AND THE CONTENT ARE DISTRIBUTED ON AN "AS IS, AS AVAILABLE" BASIS. HYPRDEV LLC, THIRD-PARTY CONTENT PROVIDERS, AND THEIR RESPECTIVE AGENTS DISCLAIM ALL WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF AVAILABILITY, ACCURACY, USEFULNESS, TITLE, MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
HYPRDEV LLC AND THIRD-PARTY PROVIDERS DO NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED OR ERROR FREE OR THAT FILES AVAILABLE FOR DOWNLOAD WILL BE FREE OF VIRUSES OR OTHER HARMFUL FEATURES. YOU EXPRESSLY AGREE THAT THE ENTIRE RISK AS TO THE QUALITY AND PERFORMANCE OF THE SITE AND THE ACCURACY OR COMPLETENESS OF THE CONTENT IS ASSUMED SOLELY BY YOU.
Limitation of Liability
IN NO EVENT SHALL HYPRDEV LLC, ITS AFFILIATES, AGENTS, SHAREHOLDERS, EMPLOYEES, OR OFFICERS BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES, INCLUDING ATTORNEYS' FEES AND LOST PROFITS, RESULTING FROM OR ARISING OUT OF THE USE OF OR INABILITY TO USE THE SITE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
IN NO EVENT SHALL THE LIABILITY OF HYPRDEV LLC, ITS AFFILIATES, AGENTS, SHAREHOLDERS, EMPLOYEES, OR OFFICERS EXCEED $100.00, REGARDLESS OF THE CAUSE OF ACTION. SOME STATES DO NOT ALLOW EXCLUSION OF IMPLIED WARRANTIES OR LIMITATION OF LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO SOME OF THE ABOVE LIMITATIONS MAY NOT APPLY TO YOU.
Governing Law; Venue; Statute of Limitations
This Agreement shall be construed in accordance with the laws of the State of Delaware, and the parties irrevocably consent to jurisdiction in the federal or state courts located in New Castle County, Delaware for actions to enforce this Agreement.
To the maximum extent permitted by applicable law, you agree that any claim against us must be brought within one year from when the claim arose, and claims not brought within that period shall be deemed waived.
Copyrights
If you believe that the Site includes your work and that it has been copied in a way that constitutes copyright infringement, please provide our copyright agent with an electronic or physical signature of the authorized person, a description of the copyrighted work, a description of where the allegedly infringing material is located, your contact information, a statement of good-faith belief that the disputed use is not authorized, and a statement under penalty of perjury that the notice is accurate and that you are authorized to act on behalf of the copyright owner.

International Use
PayCalculator.us and PayCalculator.us Payroll are designed for use by residents of the United States only. Recognizing the global nature of the Internet, you agree to comply with local rules regarding online conduct and with all applicable laws regarding the transmission of technical data exported from the United States or the country in which you reside.
Privacy Policy
As part of this Agreement, your use of the Site is subject to our Privacy Policy, which is incorporated by reference.

COPPA
We do not knowingly solicit data from children or knowingly market to children under age 13. If we receive actual knowledge that we have collected children's personal information without the required parental consent, we will delete that information as quickly as reasonably practical.
IRS Circular 230 Notice
Nothing in our communications with you, including emails, web site content, attachments, enclosures, or other accompanying materials relating to any federal tax transaction or matter, is considered to be a "covered opinion" as described in Circular 230.
Miscellaneous
This Agreement and any materials incorporated into it constitute the entire agreement between the parties with respect to the subject matter hereof and supersede all previous written or oral agreements relating to that subject matter.
Failure to exercise or enforce any right or provision does not constitute a waiver of that right or provision. If any inconsistency exists between this Agreement and additional terms posted on the Site, the terms shall be interpreted to eliminate the inconsistency where possible, and otherwise the additional terms shall control.
The provisions of this Agreement are severable, and the invalidity or unenforceability of any provision will not affect the validity or enforceability of the remaining provisions. Any provision determined to be invalid or unenforceable will be modified, to the extent possible, to remain valid and enforceable while preserving the intent of the parties.
